The calculator supports six distribution methods: Hours-Weighted (tips divided by hours worked), Points-Based (role-weighted distribution), Points × Hours Hybrid (combines both factors), Percentage of Tips (traditional tip-outs), Percentage of Sales (sales-based distribution), and Equal Split (even distribution among participants).
Tip pooling is legal under federal law (FLSA), but rules vary by state. Since 2018, employers who pay full minimum wage (no tip credit) can include back-of-house staff in tip pools. Our calculator includes state-specific rules and compliance checks to help you stay legal. However, managers and supervisors are always excluded from tip pools.
In a points-based pool, each role is assigned a point value (e.g., Server = 10, Busser = 5, Host = 3). The total pool is divided by total points worked, then each employee receives their share based on their role's points. This rewards higher-responsibility positions while still sharing tips fairly.
Yes, but it depends on your state. Some states allow employers to deduct the processing fee percentage from credit card tips before pooling. The calculator lets you configure this and will warn you if your state doesn't allow it. The deduction must be proportional and cannot exceed the actual fee charged.
Tip credit allows employers in some states to pay tipped employees below minimum wage, using tips to make up the difference. If you use tip credit, there are restrictions on who can participate in the pool (generally only "traditionally tipped" front-of-house staff).
